SARL SAMALO attaches great importance to safeguarding the personal data entrusted to us by our clients in connection with our Services. This Privacy Charter is intended to inform you about our policy on personal data, and in particular about the data we collect, how we process it, the purposes for which we use it and with whom we share it.

More specifically, this Charter describes how we use your personal data when you use our website / web application or when you interact with us through other channels (hotline, social media platforms).

It is recalled that personal data (hereinafter “Data” or “Personal Data”) means “any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity”.

Processing of data (hereinafter “Processing” or “Processing of Data”) means “any operation or set of operations which is performed on data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction”.

For what purpose do we process your Personal Data?

SARL SAMALO processes the information provided by interested parties in order to carry out the administrative management of the services requested, as well as to send commercial communications about our products and services, for which you will have given your prior consent.

How long will we keep your Data?

The Personal Data you provide to us will be kept for as long as the contractual / commercial relationship in force is maintained and, where applicable, for the years necessary to comply with the legal obligations incumbent upon it.

  • Client data is kept for the duration of the contractual relationship plus 3 years for engagement and prospecting purposes, without prejudice to retention obligations or limitation periods.
  • With regard to the prevention of money laundering and terrorist financing, data is kept for 5 years after the end of the relationship with the Provider.
  • With regard to accounting, it is kept for 10 years from the close of the financial year.
  • Prospect data is kept for a period of 3 years if no participation in or registration for the Provider’s events has taken place.

The data processed is intended for the Provider’s authorised personnel. Under the conditions laid down by the French Data Protection Act and the European data protection regulation, natural persons have a right of access to the data concerning them, and rights of rectification, enquiry, restriction, portability and erasure.

What is the lawful basis for Processing your Data?

The legal basis for Processing your Data is: the performance of a contract, the provision of the services requested, the consent of the interested party, and the sending of commercial communications.

To whom will your Data be disclosed?

Your Data will be disclosed only to the entities of the group to which the company responsible for the Processing belongs and for which we have duly obtained your consent, as well as to third parties in order to comply with legal obligations.

Where the regulations in force so require, SARL SAMALO may transmit your Data to the bodies and authorities legally authorised to access it (in particular the judicial and administrative authorities).

We may share Personal Data with our business partners in connection with the Services provided or offered by SARL SAMALO. In that case all measures are taken to ensure a high level of security in the protection of Personal Data and all Processing is carried out in accordance with our instructions. They may under no circumstances make any use of the Personal Data transmitted to them other than that expressly required, nor disclose the Personal Data to any other third party.

In all cases, the only other occasions on which Personal Data may be transmitted to a third party are the following:

  • We have obtained your prior consent to that effect.
  • The information is processed via a trusted business partner in compliance with the Privacy Charter, respect for privacy and security levels, on the basis of the contract concluded between that business partner and SARL SAMALO.
  • We call upon third-party service-provider companies or bodies for the purposes of technical subcontracting.
  • We have a duty to disclose or communicate Personal Data in order to comply with our legal obligations, to enforce our terms of sale and other agreements, and to protect our rights, our property or our security, or those of our clients or others. This includes the exchange of information with other companies or bodies for the purpose of preventing fraud and reducing credit risk.

Transfers of Data to third countries

Transfers of Data will be made to third countries for which your consent has been duly obtained.

Cookies and trackers

When you arrive on the site, no tracker subject to consent is placed. A banner allows you to accept, refuse or customise the following categories — refusing has no impact on your browsing:

  • Site operation — essential technical cookies (security, session), exempt from consent.
  • Audience measurement — visitor statistics (Google Analytics, via Google Tag Manager), placed only with your agreement.
  • Advertising — measurement of our campaigns and personalised advertising (Facebook Pixel, advertising tags), placed only with your agreement.

Your choice (whether you accept or refuse) is stored for 6 months in a first-party cookie named “mdp_consent”, after which the banner is shown to you again. You can change your mind at any time: if you withdraw consent, the measurement and advertising cookies are deleted and the page is reloaded without any tracker.

Anti-robot protection of the contact form

The contact form is protected by Cloudflare Turnstile, an anti-robot verification service. When the form is submitted, your IP address and a technical token are transmitted to Cloudflare, Inc. in order to distinguish a human visitor from an automated system. This processing is based on our legitimate interest in protecting the site against automated submissions; it does not place any advertising cookie and is not used to track your browsing.

Security of Personal Data

We have put in place a number of technical and organisational measures to ensure the security and protection of the Personal Data processed. Nevertheless, if the Personal Data is transmitted to us via a means of communication operating over the Internet, we cannot guarantee that this Data is perfectly secure.

Accuracy of Personal Data

We endeavour to ensure that the Personal Data held is accurate, current and complete. We respond in a timely manner to requests from our clients wishing to rectify inaccurate information. Accordingly, any person about whom we hold Personal Data has the opportunity to let us know.

What are your rights when you provide us with your information?

Every person has the right to obtain confirmation as to whether or not their Personal Data is being processed by SARL SAMALO.

At any time and in accordance with the legislation in force on the protection of Personal Data, you have a right of access, rectification and erasure where, among other things, the Data is no longer necessary for the purpose for which it was collected. Please note that if you exercise one of these rights, we may no longer be able to provide you with all or part of the Services.

In certain circumstances, interested parties may request the restriction of the processing of their Data; in that case we will keep it only for the administration or defence of claims.

In certain circumstances and for reasons relating to a particular situation, interested parties may object to the Processing of their Data. In that case, SARL SAMALO will cease processing their Data, save on compelling legitimate grounds, or for the establishment or defence of any claims.

You may exercise your rights as follows: by writing to the postal address or e-mail address of the data controller given above, enclosing a copy of your proof of identity.

If you have given your consent for a specific purpose, you have the right to withdraw the consent granted at any time, without affecting the lawfulness of the processing based on consent before its withdrawal.

SARL SAMALO undertakes not to sell or use its clients’ telephone contact details for commercial purposes. If you wish, you may register on the telephone marketing opt-out list on the website mentioned: https://www.bloctel.gouv.fr/.

Processing of reviews posted on our site

Reviews are processed in order to detect inappropriate content (such as fakes or spam).

We may remove reviews on the following grounds: harassment, incitement to hatred, shocking content, personal information, disinformation, misleading statements, obscene or coarse language, sexually explicit content, violent or graphic content, content of a tortious or criminal nature, off-topic content, advertising, repetitive or meaningless content, as well as reviews from persons who have not been clients of our establishment.

How did we obtain your Data?

The Personal Data processed by SARL SAMALO was provided directly by the data subject via this website / web application or other channels (hotline, social media platforms, chat, e-mail).

The categories of Data processed are as follows: identification data, postal and e-mail addresses, and commercial information.
